Organisational rules of the healthcare provider

§ 1.
General provisions

  1. The organisational regulations have been established on the basis of Article 24 in connection with Article 23 of the Act of 15 April 2011 on therapeutic activity (consolidated text of the Journal of Laws of 2020, item 295, as amended).
  2. The regulations define the manner and conditions of providing health services by the medical entity operating under the name: UNIDENT UNION II&IF AESTHETICA IWONA GNACH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, designation of the court: District Court for Wrocław Fabryczna in Wrocław, VI Economic Division of the National Court Register, registered under KRS no.: 0001031299, REGON no.: 52511345600011, NIP no.: 8982292154, register number of the treatment entity 000000152171, with the registered office at Jana Kochanowskiego Avenue 20/CD, 51-601 Wrocław, hereinafter referred to as "the Cabinet".
  3. The Regulations apply to all employees of the Clinic, as well as persons providing health services to the Clinic under civil law contracts, patients of the Clinic, visitors and other persons present on the premises of the Clinic in connection with the process of providing health services

§ 2.
Aims and objectives

  1. The aim of the practice is to provide dental health services, as well as health promotion and health education.
  2. The tasks of the Cabinet are:
    (a) to provide health services in accordance with current medical knowledge, respect for patients' rights and in accordance with ethical principles and generally applicable legislation;
    (b) health promotion and health education of patients;
    (c) to participate in the training of persons preparing for the medical profession and medical practitioners through the provision of directed and postgraduate traineeships and specialised training in accordance with the authorisations and permits held;
    (d) the performance of other tasks of the Cabinet to the extent required by generally applicable laws.

§ 3.
Organisational structure

  • The Cabinet performs its medical activity by means of a medical establishment under the name UNIDENT UNION II&IF AESTHETICA IWONA GNACH SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ or UNIDENT UNION II&IF AESTHETICA IWONA GNACH SP. Z O.O.
  • Within the treatment facility referred to in paragraph 1, there shall be:
    1) organisational unit - UNIDENT UNION
    2) organisational unit - dental clinic and orthodontic clinic.

§ 4.
Type and scope of health services provided

  • The practice provides outpatient health care services.
  • The practice provides outpatient dental and X-ray health services, including:
    1) Orthodontics
    2) Periodontology
    3) Dental prosthetics
    4) Paediatric dentistry
    5) Conservative dentistry with endodontics
    6) Oral surgery
    7) Radiology and diagnostic imaging
    8) providing medical consultations
    9) Issuing judgements and certificates on patients' health conditions;
    10)issuing prescriptions;
    11)Health promotion and health education of patients;
    12) training of doctors.


§ 5.
Place and course of health services

  1. Health services are provided at the inpatient facility al. Jana Kochanowskiego 20 CD, 51-601 Wrocław.
  2. Health services are provided from 8:00 a.m. to 8:00 p.m. Patient admissions take place on weekdays, at times agreed with the patient or the patient's legal representative in the manner set out in paragraph 5. In particularly justified cases, the Manager may decide to admit the patient at other times, after agreeing the admission date with the patient or the patient's legal or actual representative.
  3. Patient registration takes place in person or by telephone +48 71 3281212. During personal registration, the patient or his/her legal representative is obliged to present an identity card, give a PESEL number and other information necessary to keep medical records in accordance with the current Act on Patient's Rights and Spokesman for Patient's Rights and accept the provisions of these Regulations.
  4. Payment for the services provided is made after the service has been rendered and, according to the information provided by the doctor or receptionist, the visit/service may be prepaid and, in the case of consultations, payment in advance may apply. Should the need for additional services arise during the course of the service, the patient will be informed of this need as well as the cost of the additional services. Payment for additional services shall be made after they have been provided, but no later than on the day of the visit.
  5. The patient has the right to cancel an appointment 48 hours before the scheduled appointment. The appointment must be cancelled by means of an e-mail sent to: biuro@unidentunion.pl. If the appointment is not cancelled within the time limit referred to in the preceding sentence and the Patient does not attend the appointment, or the appointment is cancelled within a shorter time limit than that referred to in the preceding sentence, the deposit paid will be forfeited to Unident Union.
  6. The surgery accepts the following forms of payment:
    (a) cash;
    b) bank transfer;
    (c) credit/payment card.
  7. Prior to the provision of services, the patient is obliged to provide the personnel providing the services with all information and explanations that will be necessary to ensure the proper provision of health services by completing a medical history, including, in particular, the presentation of the medical records in their possession together with the results of examinations.
  8. The conditions for the provision of health services are:
    a. Registration of the visit in accordance with the provisions of the Regulations,
    b. payment of benefits,
    c. completion of a medical history,
    d. undergo the diagnosis indicated by the doctor,
    e. the Patient's informed consent to the provision of health services,
    f. the provision by the patient of the information referred to in paragraph 6;
    g. positive qualification of the patient.
    h. to be aware of the principles of personal data protection, including the content of the information provided when data is collected from the data subject (Article 13 of the DPA).

§ 6.
Availability of health services

  1. The practice organises health services in a way that ensures that patients have the best possible accessibility and the most convenient way of accessing services.
  2. Health care services are provided to patients against payment, based on the price list in force on the date of service provision, as determined by the Board of Directors and available in full form at the entity's registered office, as well as in summary form on the website of the www.unidentunion.pl.
  3. The Cabinet reserves the right to refuse to admit a Patient or to discontinue further health services in the following cases:
    (a) if the Patient's state of health does not permit the provision of health services;
    b) if the conditions set out in § 5 para. 7 are not met;
    (c) in the event of an epidemic emergency or for safety reasons
    patient health;
    (d) in the event of a breach by the patient, his or her legal representative or other persons
    accompanying the patient to the obligations and prohibitions set out in § 9, paragraphs 4 and 5 of the Rules.
    This decision shall be taken by the Manager or his deputy or other person authorised by the
    Board or Manager;
    (e) in other cases where the provision of health services is impossible for reasons of
    independent of the Cabinet Office.
    (f) In the event of a mutual loss of trust between patient and doctor.


§ 7.
Quality of health services

  1. Health services at the Clinic are provided by staff with the appropriate qualifications and authorisations as set out in separate legislation.
  2. Health services are provided to patients with due diligence, in accordance with current medical knowledge, respecting patients' rights and in conditions that meet the professional and sanitary requirements in force in this respect.
  3. Persons providing health care services to patients shall be guided by the rules of professional ethics defined by the competent self-governing bodies of the health professions.


§ 8.
Medical records

  1. The Cabinet shall keep, store and make available medical records in accordance with the principles set out in the Act of 6 November 2008 on Patients' Rights and Patients' Rights Ombudsman and implementing regulations.
  2. The Clinic ensures the protection of personal data contained in medical records in accordance with current legislation. Medical records are issued on the basis of an internal clinic document completed by the Patient (application for access to medical records)
  3. After completing the aforementioned application, the Patient is obliged to pay a fee of PLN 75 to the Unident Union account - number: 24 1140 2017 0000 4102 1272 5018 (in the title please include: patient's name, date and information that the fee relates to the release of medical records).
  4. Upon receipt of payment into the bank account, the administrative staff of the clinic undertakes to make the above document available within 14 days. The form in which medical records are made available may be in paper form by making a copy in the form of a digital reproduction (scan) or by means of electronic communication. At the request of the Patient or other authorised entities, paper documentation can be collected personally by the Patient and/or a person authorised in the internal documents of the clinic or sent to the indicated address in the form of a registered letter with acknowledgement of receipt (the cost of PLN 15 for the postage service should be added).

§ 9.
Patient's rights and obligations

  1. Health services are provided in accordance with the patient's rights set out in the Act of 6 November 2008 on Patient Rights and Patient Ombudsman, as well as in separate regulations.
  2. A patient whose rights have been violated in the course of receiving health services has the right to make a verbal or written complaint to the Manager or his/her deputy.
  3. Information on patients' rights is made available to patients at the place of treatment in written form, in a place accessible to the public and on the official website of the healthcare provider www.unidentunion.pl.
  4. The patient has a duty to:
    1) comply with the provisions of the Rules of Procedure;
    2) observe the rules of personal hygiene;
    3) respect the rights of other patients;
    4) respect the property of the Cabinet;
    5) follow the doctor's recommendations;
    6) attend appointments.
    5. On the premises of the treatment facility it is prohibited to:
    1) Alcohol consumption;
    2) smoking, including e-cigarettes;
    3) introduction of animals;
    4) canvassing and carrying out profit-making activities.
    5) Bringing in firearms with the exception of state officers on duty e.g. police or the Government Protection Bureau.

§ 10
Cabinet Management

  1. The activities of the Cabinet, are managed by the Chairman of the Board, hereinafter referred to as the "Manager".
  2. The Manager manages the affairs of the Cabinet and represents it externally and performs other duties under generally applicable legislation.
  3. The manager may appoint deputies to manage individual units or organisational units or to manage matters of a specific nature. To this end, the Manager may, in particular, grant the necessary powers of attorney or authorisations to his deputies.
  4. The Manager may delegate to a designated person the duty to supervise the regularity and quality of the health services provided, to coordinate the work of the medical staff employed or cooperating with the Practice and to supervise the regularity of the medical records.


§ 11.
Conditions for cooperation with other healthcare providers

  1. In order to ensure the correctness and continuity of the healthcare provision process, the Cabinet interacts with other healthcare providers providing healthcare services to these patients, as well as with other medical professionals and prosthetic laboratories.
  2. The cooperation shall take place in accordance with the principles set out in generally applicable legislation and with respect for the patient's rights. Detailed principles of cooperation may be defined in separate agreements.
  3. The transfer of patient data is carried out on the basis of a concluded data entrustment agreement.

§ 12.
Video surveillance of the premises

  1. In order to ensure the safety of patients and staff at the Surgery, observation of the public areas is carried out by means of image recording equipment (video surveillance). No sound is recorded as part of video monitoring.
  2. Video surveillance covers the entrance area of the treatment facility, the waiting room, the registration room and the public corridor. The rooms where health services are provided are not covered by the surveillance.
  3. The Cabinet processes personal data contained in the recordings obtained as a result of video surveillance exclusively for the purposes referred to in paragraph 1.
  4. Surveillance shall be carried out 24 hours a day. Recordings shall be recorded and stored for a period not exceeding one month. After this period, the recordings shall be destroyed by overwriting, unless otherwise stipulated by separate provisions.
  5. Recordings may be made available to entities and authorities authorised under separate legislation.
  6. The handling of the process of recording, capturing, storing and providing access to the recordings may be entrusted to a third party on the basis of a separate agreement, while observing the principles of personal data processing resulting from generally applicable laws.
  7. The Practice Manager shall inform patients and other persons who may be subject to video surveillance of the principles of processing of personal data in connection with the observation of the premises, including the purposes and legal basis for the processing, by placing an appropriate information clause in a publicly accessible place on the premises of the Practice or by referring to them in the form of a QR code or a link to the information on the website of the healthcare provider.

§ 13.
Final provisions

  1. The regulations shall enter into force on 17.04.2023.
  2. In matters not regulated in these regulations, the provisions of generally applicable law shall apply, including in particular the Act of 15 April 2011 on medical activity, the Act of 6 November 2008 on patients' rights and the Patient's Rights Ombudsman, as well as executive acts to these acts.
